1. Introduction & Acceptance

These Terms of Service ("Terms") govern your use of the PenTools platform (the "Service"), including our online store, software applications, and subscription products. The Service is operated by PenTools ("we", "us", or "our"), a company registered in Finland.

By creating an account, browsing our store, or completing a purchase, you agree to these Terms. If you do not agree, please do not use the Service.

The Service is intended for businesses and individuals of legal age (18+) in Finland and the European Union.

2. Your Account

You must provide accurate and complete information when registering an account and keep it updated. You are responsible for safeguarding your password and for all activity under your account.

You may not transfer your account to another person. Notify us immediately of any unauthorized use of your account.

3. Products & Subscriptions

We offer physical goods, digital products, and software subscriptions through our store. Product descriptions, pricing, and availability are shown on each product page and may change without notice.

Software products may offer multiple billing plans (e.g. monthly, quarterly, yearly) and optional add-on plugins. The plan you select determines the billing cycle and amount charged.

4. Recurring Billing

Subscription products are billed automatically on a recurring basis (hourly, daily, weekly, monthly, quarterly, or yearly, depending on your plan) until you cancel.

By completing a subscription checkout, you authorize us to charge your payment method through our payment provider (SumUp) for recurring amounts until the subscription is cancelled.

Recurring charges are processed automatically. You will receive a receipt for each successful charge. If a charge fails, we will retry; after repeated failures, your subscription may be suspended.

5. Payments

Payments are processed by SumUp, our third-party payment provider. We do not store your full card details on our servers. Your card information is handled securely by SumUp.

What appears on your bank statement is determined by your payment provider's settings (typically "SUMUP *PenTools").

6. Cancellations & Refunds

You may cancel a subscription at any time from your account. Cancellation stops future charges but does not refund the current billing period — you retain access until the end of the period you have already paid for.

Digital products and software subscriptions are generally non-refundable once access has been granted, except where required by EU consumer protection law.

Physical goods may be returned within 14 days of delivery in accordance with Finnish consumer law, provided they are unused and in original packaging. Contact us to initiate a return.

7. Shipping (Physical Goods)

Shipping costs and estimated delivery times are shown at checkout. We ship primarily within Finland and the EU.

Risk of loss passes to you upon delivery. If your order arrives damaged or does not arrive, contact us within 14 days and we will arrange a replacement or refund.

8. Digital Products & Licenses

Digital products and software are licensed, not sold. You receive a non-exclusive, non-transferable right to use the product for the duration of your subscription or as specified on the product page.

You may not resell, redistribute, sublicense, or reverse-engineer our software unless expressly permitted by the product's license terms.

9. Acceptable Use

You agree not to misuse the Service, including: attempting unauthorized access, disrupting service, using the Service for unlawful purposes, infringing intellectual property rights, or transmitting harmful code or content.

Violation of these rules may result in account suspension and legal action.

10. Intellectual Property

All software, designs, content, and branding on the Service are owned by PenTools or our licensors and protected by Finnish and international intellectual property laws.

Product names, logos, and brands are trademarks of their respective owners.

11. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements.

To the maximum extent permitted by law, PenTools shall not be liable for indirect, incidental, or consequential damages, or for loss of profits or data, arising from your use of the Service.

Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Privacy

We process your personal data in accordance with the EU General Data Protection Regulation (GDPR) and Finnish data protection law. Personal data is used to process orders, manage subscriptions, and improve our Service.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of Finland. Any disputes shall be resolved in the courts of Finland, without prejudice to your mandatory consumer rights under EU law.
